Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ComplyWCAG website, customer dashboard, accessibility widget, API endpoints, and related services (collectively, the "Service") operated by ComplyWCAG ("ComplyWCAG", "we", "us", or "our").

By registering an account, clicking an affirmative agreement button (e.g. "Sign In" or "Sign Up"), generating widget embed code, or accessing the Service, you ("Customer", "you", or "User") agree to be bound by these Terms and our Data Processing Agreement (DPA) where applicable. If you do not agree to these Terms, you must not access or use the Service.


1. Eligibility & Account Authority

The Service is strictly a business-to-business (B2B) SaaS platform. You represent and warrant that: (a) you are at least 18 years of age; (b) you possess full corporate authority to bind your organization to these Terms; and (c) all registration credentials provided are accurate and current. You are responsible for safeguarding your login credentials and for all actions taken under your account.

3. Privacy, DPA Precedence & Subprocessors

Our processing of personal data is governed by our Privacy Policy and our Data Processing Agreement (DPA). In the event of an express conflict between these Terms and the DPA regarding data protection, the DPA shall control. We engage vetted subprocessors (including Supabase, Vercel, Stripe, and Resend) under Standard Contractual Clauses (SCCs) to provide platform infrastructure.

4. Truthful No-Warranty of Sole Compliance

ComplyWCAG provides assistive user-interface adaptations and automated evaluation tooling. ComplyWCAG does NOT represent or warrant that the use of the widget alone will render your website 100% compliant with WCAG 2.1/2.2, ADA Title III, Section 508, or the European Accessibility Act (EAA). Full accessibility compliance requires underlying semantic HTML authoring, accessible design, and manual audits. You remain exclusively responsible for your website's legal compliance.

5. Service Commitments, SLAs & Modifications

We maintain Service Level Objectives (SLOs) as documented in our Operational Standards. We may deploy backward-compatible enhancements, security patches, or modifications to the Service. Paid enterprise support SLAs are governed by applicable order forms. In the event of planned maintenance, we provide advance notice via our public status communication channels.

6. Limitation of Liability

  1. Disclaimer of Consequential Damages: To the maximum extent permitted by applicable law, neither party shall be liable for any indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, or business interruption.
  2. Aggregate Liability Cap: To the fullest extent permitted by law, ComplyWCAG's total aggregate liability arising out of or related to these Terms shall not exceed the total fees actually paid by Customer to ComplyWCAG during the twelve (12) months preceding the incident giving rise to liability.

7. Term, Termination & Data Retrieval

Either party may terminate these Terms if the other party materially breaches these Terms and fails to cure such breach within thirty (30) days of written notice. Upon account closure or termination: (a) your license to embed the widget ceases; (b) you must remove the widget snippet from your websites; and (c) you may export your website analytics and data within a 30-day grace period, following which data is purged per our retention schedule.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration administered by JAMS in Wilmington, Delaware, or in federal or state courts situated in Delaware.

9. Changes to Terms & Notice

We may update these Terms from time to time. If a change is material, we will provide at least thirty (30) days' advance notice via email or in-app notification prior to the effective date. Continued use of the Service following the effective date constitutes affirmative acceptance of the revised Terms.
